1. Agreement to Terms & Scope
These Terms of Service ("Agreement") govern the access and use of the Cestani institutional governance, decision-making, live parliamentary voting, and 360-degree evaluation platform ("Platform"). By accessing the Platform through single sign-on (SSO), direct ballot access token, or administrative portal credentials, you agree to comply with this Agreement and your institution's governing bylaws.
2. Authorized Use & Account Integrity
Cestani is designed exclusively for authorized members, trustees, voting delegates, evaluators, and administrative officials designated by the subscribing institution.
- Non-Transferability: Single-use ballot tokens, subject reviewer management links, and authenticated session credentials are strictly personal and non-transferable. You may not share, delegate, or forward your unique voting token or evaluation URL to any third party.
- Presence & Quorum Integrity: Marking yourself present in a meeting or committee session constitutes a formal declaration of your attendance and active participation under applicable parliamentary procedure.
- Submission Finality: Once a ballot or evaluation response is submitted and confirmed, the action is irreversible under the Platform's cryptographic ledger.

4. Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
- Attempting to deanonymize, re-identify, or correlate respondents in Tier 3 or Tier 4 anonymous voting or 360 evaluation campaigns.
- Using automated scripts, bots, scrapers, or exploits to submit fraudulent votes or flood evaluation endpoints.
- Interfering with real-time WebSocket meeting channels, presence streams, or server infrastructure.
- Submitting defamatory, unlawful, or maliciously fraudulent content through open-text feedback instruments.
- Circumventing institutional quorum, executive session gating, or role-based access control (ABAC) policies.
5. Institutional Data Ownership & Sovereignty
You Own Your Data: Your institution retains 100% ownership, title, and intellectual property rights in all data, ballots, meeting transcripts, evaluation responses, and institutional rosters processed by the Platform. Cestani claims zero ownership or commercial usage rights over your governance data.
6. Service Availability & Offline Partitioning
While Cestani is architected for high availability and local offline partition resilience during live parliamentary sessions, the Platform is provided on an "as-is" and "as-available" basis. Subscribing institutions are responsible for ensuring sufficient local network connectivity during live meetings.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Cestani and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from election procedural disputes, institutional policy decisions, or unauthorized credential compromises resulting from voter negligence.
8. Modifications & Governing Law
We may update these Terms periodically to reflect architectural enhancements or legal compliance standards. Material changes will be noted on this page with an updated Effective Date. This Agreement is governed by the laws applicable to the subscribing institution's primary operating jurisdiction.
